1. AGREEMENT TO TERMS

Welcome to Cosmix! These Terms of Use constitute a legally binding agreement made between you ("you," "your," or "user") and Lyra Ventures LLC doing business as Cosmix ("we," "us," or "our") concerning your access to and use of the Cosmix mobile application (the "App").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you must not access or use the App.

The App is intended for users who are at least 13 years of age. By using the App, you represent and warrant that you meet this requirement. If you are under the age of 18, you represent that you have your parent or guardian's permission to use the App.

2. CHANGES TO THE TERMS

We reserve the right to modify these Terms of Use at our sole discretion from time to time. We will notify you of any changes by posting the new Terms of Use on this page and updating the "Last Updated" date at the top of these Terms. It is your responsibility to review these Terms of Use periodically.

Your continued use of the App following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes.

3. APP LICENSE AND RESTRICTIONS

3.1 License

Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on a mobile device owned or controlled by you.

3.2 Restrictions

You agree not to, and you will not permit others to:

License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App or make the App available to any third party.
Copy or use the App for any purpose other than as permitted under these Terms.
Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.
Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Cosmix or its affiliates, partners, suppliers, or licensors.
Use the App to transmit viruses, trojan horses, or other harmful code.
Interfere with or disrupt the integrity or performance of the App.
Attempt to gain unauthorized access to the App or its related systems or networks.
Use the App to collect or harvest any personally identifiable information.
Use the App for any illegal or unauthorized purpose.

4. USER ACCOUNTS

4.1 Account Creation

To access certain features of the App, you may be required to create an account. When you create an account, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your mobile device.

4.2 Account Security

You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss that you may incur as a result of someone else using your account, either with or without your knowledge.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to, your breach of these Terms of Use. Upon termination, your right to use the App will immediately cease.

5. SUBSCRIPTION SERVICE AND PAYMENTS

5.1 Freemium Model

The App operates on a freemium model, where basic features are available for free, and premium features require a paid subscription. Free users can access:

Daily quizzes with partial insights (first paragraph only)
Two visualization cards per quiz result
Quiz history retention for 3 days
Ability to add one friend
Limited friend quizzes

5.2 Premium Subscription

Premium subscribers receive:

Complete quiz results with full insights
All visualization cards
Permanent quiz history retention
Unlimited friends
Unlimited friend quizzes
Chat history retained indefinitely

5.3 Subscription Terms

Subscription prices are clearly displayed in the App before purchase.
Subscriptions are available in weekly ($2.99/week) or annual ($79.99/year) options.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
You can manage your subscription and turn off auto-renewal by:
- For Apple users: Accessing your account settings in the App Store
- For Google users: Accessing Google Play's Subscription Center through your device settings
If you cancel your subscription, you will continue to have access to premium features until the end of your current billing period. No refunds will be provided for partial subscription periods except as required by applicable law or platform policies.
If subscription prices change, you will be notified in advance according to platform policies. Continued use of premium features after a price change takes effect constitutes your acceptance of the new price.

5.4 Promotional Offers

We may occasionally offer promotional "Cosmic Rewards" that provide temporary access to premium features. These offers may have different terms and limitations, which will be disclosed at the time of offer.

5.5 Payment Processing

Payment for subscriptions is processed directly through your App Store or Google Play account. By subscribing, you authorize Apple or Google to charge your selected payment method according to the terms of your subscription.

6. USER CONTENT AND CONDUCT

6.1 User Content

You may have the ability to create, post, or share content through the App ("User Content"), including quiz responses, comments, and friend information. You retain all rights in your User Content, but you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the operation and provision of the App.

6.2 Friend Data

When you add friend information to the App:

You represent that you have obtained the consent of your friends to provide their birth details to us.
You acknowledge that you are solely responsible for ensuring that you have the right to share such information.
You agree not to add information about individuals under the age of 13.
You understand that friend data will be used to calculate astrological compatibility and provide personalized insights.
You have the right to request deletion of your personal data, including friend information you've provided, through the app settings or by contacting us at info@cosmixastrology.com.

6.3 User Conduct

You agree not to use the App or User Content to:

Violate any applicable law or regulation.
Infringe the rights of any third party, including privacy rights, publicity rights, copyright, trademark, patent, trade secret, or other intellectual property rights.
Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
Submit false or misleading information.
Act in any way that could harm minors.
Impersonate any person or misrepresent your identity or affiliation with any person or organization.

7. INTELLECTUAL PROPERTY RIGHTS

7.1 App Content

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by Cosmix, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7.2 Trademarks

The Cosmix name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Cosmix or its affiliates or licensors. You must not use such marks without our prior written permission.

7.3 Feedback

Any feedback, comments, or suggestions you may provide regarding the App is entirely voluntary, and we will be free to use such feedback, comments, or suggestions without any obligation to you.

8. THIRD-PARTY SERVICES

8.1 Third-Party Services

The App may contain links to or integrations with third-party websites, services, or resources that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such third-party websites or services.

8.2 Third-Party Providers

We use the following third-party service providers to operate the App:

Supabase: For database storage, user authentication, and edge functions
Google Places API: For location search during birth location input
Twilio: For SMS authentication
Google Gemini: For generating quiz questions and personalized results
Anthropic: For AI chat functionality and conversation processing
OpenAI: For AI chat functionality and content generation
Payment processors: To process subscription payments

Your use of these third-party services is subject to their respective terms of service and privacy policies.

9. DISCLAIMERS

9.1 App Disclaimer

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Astrological Disclaimer

Astrological insights, quiz results, and other content provided through the App are for entertainment and informational purposes only. We make no guarantees, representations, or warranties, whether express or implied, regarding the accuracy, reliability, or completeness of any astrological predictions or advice provided through the App.

9.3 Content Disclaimer

We do not guarantee the accuracy, completeness, or usefulness of any information provided through the App, and we shall not be responsible or liable for any user's reliance on such information.

10. LIMITATION OF LIABILITY

IN NO EVENT SHALL COSMIX, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP;
ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP;
ANY CONTENT OBTAINED FROM THE APP; AND
UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT,

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST SIX MONTHS.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Cosmix, its licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the App, including, but not limited to, your User Content, any use of the App's content, services, and products other than as expressly authorized in these Terms of Use.

12. GOVERNING LAW

These Terms of Use and your use of the App shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms of Use or the App shall be instituted exclusively in the federal courts of the United States or the courts of the State of California.

13. DISPUTE RESOLUTION

13.1 Informal Resolution

In the event of any dispute arising from or relating to these Terms of Use or your use of the App, you agree to first attempt to resolve the dispute informally by contacting us.

13.2 Arbitration

If a dispute cannot be resolved informally, you and Cosmix agree that any dispute, claim, or controversy arising out of or relating to these Terms of Use or the App shall be determined by binding arbitration. You agree to arbitrate solely on an individual basis, and that these Terms do not allow class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding.

13.3 Exceptions

The arbitration agreement does not apply to any claim (a) in which a party seeks injunctive or other equitable relief for the alleged unlawful use of intellectual property or (b) that may be brought in small claims court.

14. SEVERABILITY

If any provision of these Terms of Use is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

15. WAIVER

Our failure to enforce any right or provision of these Terms of Use will not be considered a waiver of those rights. If we fail to enforce any right or provision of these Terms of Use in one instance, that doesn't mean we waive our right to enforce that right or provision in other instances.

16. ENTIRE AGREEMENT

These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede any prior agreements between you and us relating to your use of the App.

17. DATA DELETION

You have the right to request deletion of your personal information collected through the App. To exercise this right, you may:

Use the in-app deletion option in the App settings

We will process your request within a reasonable timeframe as required by applicable law.
